{"id":4839,"date":"2026-04-17T15:32:41","date_gmt":"2026-04-17T15:32:41","guid":{"rendered":"https:\/\/gunowner-news.com\/?p=4839"},"modified":"2026-04-17T15:32:41","modified_gmt":"2026-04-17T15:32:41","slug":"supreme-court-sides-with-oil-companies-in-louisiana-coastal-lawsuits","status":"publish","type":"post","link":"https:\/\/gunowner-news.com\/?p=4839","title":{"rendered":"Supreme Court Sides With Oil Companies in Louisiana Coastal Lawsuits"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div data-testid=\"companionColumn-0\">\n<div class=\"css-53u6y8\">\n<p class=\"css-ac37hb evys1bk0\">The Supreme Court agreed on Friday that energy companies facing lawsuits over environmental damage to Louisiana\u2019s coast from oil and gas production can move the challenges from state courts into friendlier federal venues.<\/p>\n<p class=\"css-ac37hb evys1bk0\">The ruling is a significant victory for oil companies, led by Chevron and Exxon Mobil, in their legal battle with Louisiana state officials over who should pay for the state\u2019s coastal erosion. The companies have been supported by the Trump administration.<\/p>\n<p class=\"css-ac37hb evys1bk0\">The justices <a class=\"css-yywogo\" href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/24-813_3e04.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">unanimously agreed<\/a> to allow the oil companies to fight the lawsuits in federal court rather than state court.<\/p>\n<p class=\"css-ac37hb evys1bk0\">\u201cCongress has long authorized federal officers and their agents to remove suits brought against them in state court to federal court,\u201d Justice Clarence Thomas wrote.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-ac37hb evys1bk0\">The case, <a class=\"css-yywogo\" href=\"https:\/\/www.supremecourt.gov\/search.aspx?filename=\/docket\/docketfiles\/html\/public\/24-813.html\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">Chevron USA Inc. v. Plaquemines Parish, La.<\/a>, focused on a narrow question: whether the oil companies could remove cases over environmental damage from state to federal court. But the case has been closely watched by litigants in <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/01\/13\/climate\/supreme-court-hawaii-climate-lawsuit.html\" title=\"\">other climate lawsuits<\/a> because state courts are generally thought to be more receptive to people who sue over damages caused by climate change, including climate activists and state officials.<\/p>\n<p class=\"css-ac37hb evys1bk0\">Justice Thomas explained that the oil company had cleared the bar required to move the case into federal court because the lawsuit dealt with oil production in Louisiana dating back to World War II, when Chevron refined crude oil into aviation gasoline for the U.S. military.<\/p>\n<p class=\"css-ac37hb evys1bk0\">He wrote that Chevron had shown that its wartime production of crude oil related to its wartime aviation-gasoline refining for the military, a federal priority.<\/p>\n<p class=\"css-ac37hb evys1bk0\">Louisiana has <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/interactive\/2018\/02\/24\/us\/jean-lafitte-floodwaters.html\" title=\"\">lost about 2,000 square miles of land<\/a> to coastal erosion since the 1930s \u2014 a land mass about the size of Delaware.<\/p>\n<p class=\"css-ac37hb evys1bk0\">Plaquemines Parish, the state\u2019s southernmost parish, juts into the water where the Mississippi River meets the Gulf of Mexico. The parish, which is <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/04\/05\/us\/chevron-trial-louisiana-damages.html\" title=\"\">crisscrossed<\/a> with oil and gas canals, has already <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/interactive\/2020\/07\/21\/magazine\/louisiana-coast-engineering.html\" title=\"\">lost nearly half<\/a> of its size in the last century as sea levels rise because of climate change. The parish has also become more vulnerable to storms, in part because levees built to shield New Orleans from flooding also deprive the delicate coastal ecosystem of fresh water and sediment. Canals that aid in oil and gas production have also weakened the ecosystem, experts have said.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-ac37hb evys1bk0\">Louisiana has a <a class=\"css-yywogo\" href=\"https:\/\/coastal.la.gov\/our-plan\/2023-coastal-master-plan\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">$50 billion master plan<\/a> to try to preserve coastal land, including more than 100 projects to dredge sand, to rebuild marshes and to add flood protection measures, including levees and storm surge barriers. The plan is designed to create tens of thousands of acres of new land and to shore up what remains.<\/p>\n<div id=\"NYT_MAIN_CONTENT_2_REGION\" class=\"css-9tf9ac\" data-testid=\"region\">\n<section data-testid=\"inline-interactive\" id=\"tips-courts-promo-capsule\" data-id=\"100000009977129\" data-source-id=\"100000009977129\" class=\"interactive-content interactive-size-scoop css-retkgj\">\n<div class=\"css-17ih8de interactive-body\" data-sourceid=\"100000009977129\" id=\"embed-id-100000009977129\">\n<div data-rir-instance-id=\"2VXIE+RJQ0JtAR\/jXBNC8taHTFU=\">\n<div class=\"trust-survey-component css-1mxer6r\" data-slug=\"tips-courts-promo-capsule\" data-iterate-survey=\"62fbffa010eae90001b94079\">\n<p class=\"css-1medn6k\"><span class=\"css-1f84s5v\">Got a news tip about the courts?<\/span>\u00a0<span class=\"css-1hvpcve\">If you have information to share about the Supreme Court or other federal courts, please contact us.<\/span><span class=\"css-1hvpcve\"\/><\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/section>\n<\/div>\n<p class=\"css-ac37hb evys1bk0\">So far, much of the money has come from a settlement that followed<strong class=\"css-8qgvsz ebyp5n10\"> <\/strong>the 2010 Deepwater Horizon oil spill, but that fund is running out.<\/p>\n<p class=\"css-ac37hb evys1bk0\">Local parishes, entities similar to counties in other states, have filed more than 40 lawsuits since 2013, seeking billions of dollars in damages from oil companies, which the parishes accuse of damaging the state\u2019s coast line over decades of production.<\/p>\n<p class=\"css-ac37hb evys1bk0\">They argue that the companies have illegally drilled, dredged and engaged in waste disposal without proper permits.<\/p>\n<p class=\"css-ac37hb evys1bk0\">The lawsuits have gained support from Louisiana Republican leaders, including those who have otherwise endorsed President Trump\u2019s \u201cenergy dominance\u201d agenda. Gov. Jeff Landry and Attorney General Liz Murrill, both Republicans, have supported the legal challenges.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-3\">\n<div class=\"css-53u6y8\">\n<p class=\"css-ac37hb evys1bk0\">The parishes sued under Louisiana\u2019s State and Local Coastal Resources Management Act, arguing that the companies violated a provision of the statute that requires companies to make sure that work areas are \u201ccleared, revegetated, detoxified and otherwise restored.\u201d<\/p>\n<p class=\"css-ac37hb evys1bk0\">The fossil fuel companies have fought back, arguing that their actions did not damage the coastline. They have also argued that the state law was put into place decades after the companies began their work in the area, initially extracting oil under federal contracts during World War II. The work played a key role providing aviation fuel to the United States and its allies, they have argued.<\/p>\n<p class=\"css-ac37hb evys1bk0\">These war efforts, the companies said, meant the lawsuits should be heard by federal courts, not state ones. They pointed to what is known as the federal officer removal statute. That statute authorizes lawsuits against federal officers or people \u201cacting under\u201d them \u201cfor or relating to\u201d the officers\u2019 official duties to be moved from state to federal court.<\/p>\n<p class=\"css-ac37hb evys1bk0\">Lawyers for the oil companies had argued that the companies\u2019 actions fit within the statute because of their federal contracts to refine aviation gasoline.<\/p>\n<p class=\"css-ac37hb evys1bk0\">A federal trial court judge concluded that the oil companies had failed to show that they extracted the oil under the order of a federal officer and that the federal contracts were unrelated to the oil production at issue.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-4\">\n<div class=\"css-53u6y8\">\n<p class=\"css-ac37hb evys1bk0\">A divided panel of federal judges on the U.S. Court of Appeals for the Fifth Circuit, which is based in New Orleans, <a class=\"css-yywogo\" href=\"https:\/\/www.ca5.uscourts.gov\/opinions\/pub\/23\/23-30294-CV0.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">upheld the lower court\u2019s decision<\/a> that the cases belonged in state court.<\/p>\n<p class=\"css-ac37hb evys1bk0\">The Trump administration had joined onto the case on the side of the oil companies, also arguing that the cases should be heard in federal court.<\/p>\n<p class=\"css-ac37hb evys1bk0\">Only eight of the nine justices heard the case when it was <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2026\/01\/12\/us\/politics\/supreme-court-louisiana-oil.html\" title=\"\">argued<\/a> before the court in January. Justice Samuel A. Alito Jr. recused himself in the days before the oral argument, pointing to a financial interest he holds in ConocoPhillips, the parent corporation of Burlington Resources Oil and Gas Company.
