{"id":4066,"date":"2025-10-23T05:25:37","date_gmt":"2025-10-23T05:25:37","guid":{"rendered":"https:\/\/gunowner-news.com\/?p=4066"},"modified":"2025-10-23T05:25:37","modified_gmt":"2025-10-23T05:25:37","slug":"court-rejects-journalists-case-over-not-filing-original-signature-from-gaza","status":"publish","type":"post","link":"https:\/\/gunowner-news.com\/?p=4066","title":{"rendered":"Court Rejects Journalist\u2019s Case Over Not Filing Original Signature From Gaza"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p><span class=\"has-underline\">A regional court<\/span> in Frankfurt, Germany, dismissed Palestinian photojournalist Anas Zayed Fteiha\u2019s legal action against German media giant Axel Springer, deeming the claim as inadmissible.<\/p>\n<p>Fteiha, supported by the European Legal Support Center, <a href=\"https:\/\/theintercept.com\/2025\/09\/14\/journalist-axel-springer-hamas-israel-gaza\/\">accused the publisher<\/a> in court of violating his constitutional rights by falsely depicting him as a Hamas propagandist in BILD, Germany\u2019s largest tabloid.<\/p>\n<p>The court dismissed the motion on formal grounds, ruling that Fteiha\u2019s lawyer, Ingrid Yeboah, failed to submit a valid power of attorney in its original form \u2014 a document signed by Fteiha \u2014 or in an electronically certified version, a requirement under procedural codes.<\/p>\n<p>The judges acknowledged that obtaining an original document by Fteiha from Gaza posed an exceptional challenge. They found, however, that these circumstances did not justify waiving procedural requirements and that Yeboah had not sufficiently demonstrated the impossibility of submitting the original form.<\/p>\n<figure class=\"wp-block-pullquote has-text-align-right\">\n<blockquote>\n<p>\u201cThe applicant is in a war zone with closed borders and no functioning infrastructure.\u201d<\/p>\n<\/blockquote>\n<\/figure>\n<p>The court also noted inconsistencies in the materials submitted as substitutes, including photos that showed different-looking signatures and variations in transliterations of Fteiha\u2019s family name. Videos and scans showing Fteiha in Gaza signing the documents, the judges said, did not convincingly prove authorization.<\/p>\n<p>A spokesperson for BILD said the paper stood by the story in question.<\/p>\n<p>\u201cThe Frankfurt Regional Court\u2019s decision is clear and leaves nothing to add,\u201d BILD\u2019s spokesperson Christian Senft told The Intercept. \u201cBeyond that, our portrayal constitutes a permissible expression of opinion and cannot be prohibited.\u201d<\/p>\n<p><!-- BLOCK(cta)[0](%7B%22componentName%22%3A%22CTA%22%2C%22entityType%22%3A%22SHORTCODE%22%2C%22optional%22%3Atrue%7D)(%7B%7D) --><\/p>\n<p><!-- END-BLOCK(cta)[0] --><\/p>\n<p>Procedural hurdles complicated the case from the start. German law requires submission of an original, signed power of attorney. Fteiha\u2019s lawyers had instead submitted videos showing him displaying his press ID and signing the authorization on camera, along with a digital signature.<\/p>\n<p>Another issue was the requirement of a valid address. Fteiha has been repeatedly displaced by Israeli airstrikes in recent years. Yeboah provided an alternative address. In a military campaign with <a href=\"https:\/\/theintercept.com\/2024\/06\/25\/israel-gaza-war-journalists-killed\/\">record levels<\/a> of <a href=\"https:\/\/theintercept.com\/2025\/03\/27\/israel-palestinian-drone-journalists-killed-gaza\/\">journalists killed<\/a>, Israel has justified its targeting of media workers in Gaza by <a href=\"https:\/\/www.pbs.org\/newshour\/world\/israel-targets-and-kills-al-jazeera-correspondent-anas-al-sharif-in-gaza-airstrike-as-journalist-toll-grows\">alleging they are involved with Hamas<\/a>.<\/p>\n<p>The story put Fteiha\u2019s job title \u2014 \u201cjournalist\u201d \u2014 in quotation marks and gave the story a headline that said, \u201cThis Gaza Photographer Stages Hamas Propaganda.\u201d<\/p>\n<p>Fteiha asked the court to force the removal of sections of the story that suggested he staged images of hunger and exaggerated the scale of Gaza\u2019s hunger crisis to serve Hamas\u2019s interests. His legal action argued that the piece violated German press law by spreading falsehoods and breaching the legal standards of \u201csuspicion reporting.\u201d The Intercept<a href=\"https:\/\/theintercept.com\/2025\/09\/14\/journalist-axel-springer-hamas-israel-gaza\/\"> first reported on his filing<\/a> in September.<\/p>\n<p>Axel Springer rejected Fteiha\u2019s filing as baseless. During a hearing on October 9, Axel Springer\u2019s attorney, Anika Kruse, argued that the term \u201cstaging\u201d in the BILD article did not in and of itself suggest that Gaza\u2019s crisis was fabricated, but that Fteiha\u2019s images were framed in a way that served Hamas\u2019s interests.<\/p>\n<p>In their written response to Fteiha\u2019s filing, Axel Springer attorneys described Fteiha\u2019s profession in quotation marks and said they \u201clacked knowledge\u201d as to whether he had or did not have connections to Hamas.<\/p>\n<p>During the October 9 hearing, presiding judge Ina Frost appeared skeptical of Axel Springer\u2019s legal defense. She noted that statements implying Fteiha promoted Hamas propaganda could be unlawful and described BILD\u2019s use of the word \u201cstaging\u201d as indeed problematic.<\/p>\n<p>Frost encouraged Axel Springer twice to settle by taking the article offline \u2014 in exchange for the plaintiff covering legal costs. The publisher declined both times.<\/p>\n<p>The case followed an investigation by Spiegel, a rival German news outlet, that debunked BILD\u2019s claim that Fteiha had staged photos of food distribution in Gaza. It was \u201cunfortunate,\u201d she said, that the court chose not to address the substance of the case, noting the judges\u2019 earlier suggestion of a settlement involving of the article in question.<\/p>\n<p>Fteiha is now weighing whether to appeal to a higher court.
