{"id":3906,"date":"2025-09-07T09:19:24","date_gmt":"2025-09-07T09:19:24","guid":{"rendered":"https:\/\/gunowner-news.com\/?p=3906"},"modified":"2025-09-07T09:19:24","modified_gmt":"2025-09-07T09:19:24","slug":"pentagon-official-trump-boat-strike-was-a-criminal-attack-on-civilians","status":"publish","type":"post","link":"https:\/\/gunowner-news.com\/?p=3906","title":{"rendered":"Pentagon Official: Trump Boat Strike Was a Criminal Attack on Civilians"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p><span class=\"has-underline\">The lethal strike<\/span> on a boat in the Caribbean <a href=\"https:\/\/theintercept.com\/2025\/09\/02\/trump-military-venezuela-drug-boat\/\">on Tuesday<\/a> was a criminal attack on civilians, according to a high-ranking Pentagon official who spoke to the Intercept on the condition of anonymity.\u00a0<\/p>\n<p>The Trump administration paved the way for the attack, he said, by firing the top legal authorities of the Army and the Air Force earlier this year.<\/p>\n<p>\u201cThe U.S. is now directly targeting civilians. Drug traffickers may be criminals but they aren\u2019t combatants,\u201d the Department of Defense official said. \u201cWhen Trump fired the military\u2019s top lawyers the rest saw the writing on the wall, and instead of being a critical firebreak they are now a rubber stamp complicit in this crime.\u201d<\/p>\n<p><!-- BLOCK(cta)[0](%7B%22componentName%22%3A%22CTA%22%2C%22entityType%22%3A%22SHORTCODE%22%2C%22optional%22%3Atrue%7D)(%7B%7D) --><\/p>\n<p><!-- END-BLOCK(cta)[0] --><\/p>\n<p>President Donald Trump claimed that the attack was aimed \u201cagainst positively identified Tren de Aragua Narcoterrorists,\u201d in a <a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/115136798909755892?oref=d_brief_nl&amp;utm_source=Sailthru&amp;utm_medium=email&amp;utm_campaign=The%20D%20Brief:%20September%2004%2C%202025&amp;utm_term=newsletter_d1_dbrief\">TruthSocial<\/a> post. He continued: \u201cTDA is a designated Foreign Terrorist Organization, operating under the control of [Venezuelan President] Nicolas Maduro, responsible for mass murder, drug trafficking, sex trafficking, and acts of violence and terror across the United States and Western Hemisphere.\u201d\u00a0<\/p>\n<p>Trump <a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/posts\/115136798909755892\" target=\"_blank\" rel=\"noreferrer noopener\">accompanied the post with a video<\/a>\u00a0of a four-engine speedboat cutting through the water with numerous people on board. An explosion then destroys the boat. Trump said the attack killed 11 people. It was unclear whether they were given a chance to surrender before the United States killed them.<\/p>\n<p>After days of silence, the White House issued a statement late Thursday claiming the attack was lawful. White House deputy press secretary Anna Kelly said it was \u201ctaken in defense of vital U.S. national interests and in the collective self-defense of other nations who have long suffered due to the narcotics trafficking and violent cartel activities of such organizations.\u201d<\/p>\n<p>Defense Secretary Pete Hegseth offered his own justification for the strike the same day. \u201cEvery boatload of any form of drug that poisons the American people is an imminent threat. And at the DoD our job is to defeat imminent threats,\u201d he <a href=\"https:\/\/x.com\/nickschifrin\/status\/1963696550284030145?t=3AqiKHKJPn3n2nFhJqWpMQ&amp;s=09\">told a group of journalists<\/a>. \u201cA foreign terrorist organization poisoning your people with drugs coming from a drug cartel is no different than Al Qaeda, and they will be treated as such as they were in international waters.\u201d<\/p>\n<p>Two U.S. government officials, speaking on the condition of anonymity, said that Hegseth\u2019s justification \u2013 which one called \u201ccompletely unserious\u201d \u2013 took shape after the attack.\u00a0<\/p>\n<p>Experts said Hegseth\u2019s rationale was flimsy, if not farcical. \u201cTren de Aragua being designated as a foreign terrorist organization is a purely domestic law enforcement designation. It offers no authority for the military to use deadly force,\u201d\">agreed<\/a> with Huntley, now the director of the National Security Law Program at the Georgetown University Law Center. Members of Congress<a href=\"https:\/\/archive.is\/GNsp3\"> have echoed<\/a> the assessment.<\/p>\n<p>\u201cCongress has not declared war on Venezuela, or Tren de Aragua, and the mere designation of a group as a terrorist organization does not give any President carte blanche to ignore Congress\u2019s clear Constitutional authority on matters of war and peace,\u201d said Rep. Ilhan Omar, D-Minn, in a statement. \u201cThere is no conceivable legal justification for this use of force. Unless compelling evidence emerges that they were acting in self-defense, that makes the strike a clear violation of international law.\u201d<\/p>\n<p>Hegseth said the attack would be followed by others. \u201cIt won\u2019t stop with just this strike,\u201d he told\u00a0Fox News on Wednesday<em>.<\/em>\u00a0\u201cAnyone else trafficking in those waters who we know is a designated narco-terrorist will face the same fate.\u201d<\/p>\n<p>Diosdado Cabello, the Venezuelan Minister of Interior, Justice and Peace called the Tuesday attack \u201can illegal massacre in international waters\u201d and said the United States had \u201cviolated international law.\u201d<\/p>\n<figure class=\"wp-block-pullquote has-text-align-right\">\n<blockquote>\n<p>Under international law, there\u2019s no way this even gets close to being a legitimate use of force.<\/p>\n<\/blockquote>\n<\/figure>\n<p>Brian Finucane, who worked for a decade in the Office of the Legal Adviser at the Department of State, where he advised the U.S. government on counterterrorism and other military matters, also <a href=\"https:\/\/www.justsecurity.org\/119982\/legal-issues-military-attack-carribean\/\">noted<\/a> that designating a group as a foreign terrorist organization <a href=\"https:\/\/www.justsecurity.org\/113973\/wartime-authorities-when-can-president-use\/\">does not<\/a>,\u00a0by itself, provide authority for the use of military force. <\/p>\n<p>\u201cNonetheless, such FTO designations are widely and mistakenly perceived as authorizing such action within the executive branch,\u201d he wrote in a <a href=\"https:\/\/www.justsecurity.org\/119982\/legal-issues-military-attack-carribean\/\">legal analysis<\/a> published this week. \u201cThus, designation of Tren de Aragua and a number of other Latin American criminal entities as FTOs in February foreshadowed this week\u2019s attack in the Caribbean, despite providing no actual legal authority for it.\u201d<\/p>\n<p>U.S. attacks around the world \u2013 from <a href=\"https:\/\/theintercept.com\/2022\/04\/03\/libya-airstrike-civilian-deaths-lawsuit\/\">Libya<\/a> to <a href=\"https:\/\/theintercept.com\/2023\/11\/12\/somalia-drone-strike-civilian-deaths\/\">Somalia<\/a> \u2013 during the war on terror have been justified under strained interpretations of the 2001 Authorization for the Use of Military Force.\u00a0But despite the Trump administration labeling cartels \u201cnarcoterrorists,\u201d experts say there is no plausible argument that the AUMF can apply to Tren de Aragua.<\/p>\n<p>\u201cWe knew exactly who was in that boat,\u201d Hegseth told Fox News on Wednesday. The Pentagon has <a href=\"https:\/\/www.nytimes.com\/interactive\/2017\/11\/16\/magazine\/uncounted-civilian-casualties-iraq-airstrikes.html\">frequently<\/a> claimed to have <a href=\"https:\/\/www.nytimes.com\/2021\/09\/18\/world\/asia\/afghanistan-drone-strike-reaction.html\">killed terrorists<\/a> when it has instead <a href=\"https:\/\/theintercept.com\/series\/henry-kissinger-killing-fields\/\">killed<\/a> <a href=\"https:\/\/theintercept.com\/2022\/05\/18\/drone-strike-gofundme-civilian-casualty\/\">innocents<\/a>. A 2023 investigation\u00a0by The Intercept, for example, determined that an\u00a0April 2018 drone attack in Somalia killed at least three, and possibly five, civilians, including\u00a022-year-old Luul Dahir Mohamed and her\u00a0<a href=\"https:\/\/theintercept.com\/2023\/11\/12\/somalia-drone-strike-civilian-deaths\/\">4-year-old daughter\u00a0<\/a>Mariam Shilow Muse. At the time, the military announced it had killed\u00a0\u201c<a href=\"https:\/\/www.africom.mil\/pressrelease\/30541\/u-s-conducts-airstrike-in-support-of-the-federal-government-of-somalia\" target=\"_blank\" rel=\"noreferrer noopener\">five terrorists<\/a>\u201d<a href=\"https:\/\/www.africom.mil\/pressrelease\/30541\/u-s-conducts-airstrike-in-support-of-the-federal-government-of-somalia\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a0<\/a>and that \u201cno civilians were killed in this airstrike.\u201d\u00a0<\/p>\n<p>Several experts and government officials speculated that the boat the U.S. struck on Tuesday may not even have been smuggling drugs due to what they said was an unusually large number of people on board the vessel.<\/p>\n<figure class=\"wp-block-ft-photo is-style-default alignwide\">\n    <figcaption class=\"photo__figcaption\">\n      <span class=\"photo__caption\">Secretary of Defense Pete Hegseth departs Joint Base Andrews, Maryland, Sept. 4, 2025.<\/span>\u00a0<span class=\"photo__credit\">Photo: U.S. Air Force Staff Sgt. Madelyn Keech\/Office of the Secretary of Defense Public Affairs\/DVIDS<\/span>    <\/figcaption><\/figure>\n<p><span class=\"has-underline\">Experts and government officials<\/span> were incredulous that a judge advocate signed off on the strike, variously speculating that any lawyer involved must have been ignored, pressured or simply capitulated to the will of the president.\u00a0<\/p>\n<p>Hegseth\u00a0<a href=\"https:\/\/www.nytimes.com\/2025\/02\/22\/us\/politics\/hegseth-firings-military-lawyers-jag.html\">fired the Air Force\u2019s and Army\u2019s top judge advocates general (JAGs)<\/a> in February to <a href=\"https:\/\/www.defense.gov\/News\/Transcripts\/Transcript\/Article\/4077391\/secretary-of-defense-pete-hegseth-greets-saudi-minister-of-defense-his-royal-hi\/\">avoid<\/a>\u00a0\u201croadblocks to orders that are given by a commander in chief.\u201d The next month he <a href=\"https:\/\/www.theatlantic.com\/ideas\/archive\/2025\/03\/hegseth-brings-culture-war-combat\/681960\/\">commissioned his personal lawyer<\/a>, Timothy Parlatore,\u00a0as a Navy JAG and empowered him to help <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/mar\/13\/pete-hegseth-pentagon-lawyers-rules-of-war\">overhaul the JAG corps<\/a>, reportedly pursuing changes that would encourage lawyers to approve more aggressive tactics and take a more lenient approach to those who violate the law of war. Parlatore\u2019s prior claim to fame was successfully defending Eddie Gallagher, a Navy SEAL accused of first-degree murder in the death of a captured ISIS fighter as well as the attempted murder of civilians in Iraq. <a href=\"https:\/\/thehill.com\/opinion\/national-security\/5379554-congress-must-investigate-pete-hegseths-firing-of-military-branches-top-legal-officers\/\">Distinguished<\/a> <a href=\"https:\/\/thehill.com\/opinion\/national-security\/5484898-trump-and-hegseth-want-to-turn-the-military-into-a-tool-of-personal-loyalty\/\">former JAGs<\/a> and members of <a href=\"https:\/\/www.kaine.senate.gov\/imo\/media\/doc\/letter_to_secretary_hegseth_on_jag_firings.pdf\">Congress<\/a> have repeatedly spoken out about Hegseth\u2019s efforts to <a href=\"https:\/\/www.kaine.senate.gov\/imo\/media\/doc\/letter_to_secretary_hegseth_on_jag_firings.pdf\">undermine<\/a> the independence of military legal counsel and subvert military justice.<\/p>\n<p>In February, Trump\u00a0<a href=\"https:\/\/apnews.com\/article\/trump-cartels-foreign-terrorist-organizations-eb35567b69fc66f13f7f79fb90906a50\" target=\"_blank\" rel=\"noreferrer noopener\">designated<\/a>\u00a0Venezuela\u2019s\u00a0<a href=\"https:\/\/apnews.com\/article\/tren-de-aragua-gang-venezuela-trump-40ec0390047c2b17e961dd029da02e65\" target=\"_blank\" rel=\"noreferrer noopener\">Tren de Aragua<\/a>, MS-13 in El Salvador, and six cartels based in Mexico as foreign terrorist organizations. More recently, the Trump administration added the Venezuelan Cartel de los Soles, or Cartel of the Suns, to a list of specially designated global terrorist groups, alleging that it is headed by Maduro and high-ranking officials in his administration. In July, Trump\u00a0also <a href=\"https:\/\/www.nytimes.com\/2025\/08\/08\/us\/trump-military-drug-cartels.html\" target=\"_blank\" rel=\"noreferrer noopener\">signed a secret directive<\/a>\u00a0ordering the Pentagon to use military force against some Latin American drug cartels he<a href=\"https:\/\/www.nytimes.com\/2025\/09\/02\/us\/politics\/trump-venezuela-boat-drugs-attack.html\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a0has labeled terrorist organizations<\/a>.<\/p>\n<p>Venezuelan officials believe Trump may be renewing\u00a0<a href=\"https:\/\/theintercept.com\/2019\/01\/30\/donald-trump-and-the-yankee-plot-to-overthrow-the-venezuelan-government\/\">long-running efforts<\/a>, which failed during his first term, to topple Maduro\u2019s government. Maduro and several close allies were indicted in a New York federal court in 2020,\u00a0<a href=\"https:\/\/theintercept.com\/2020\/05\/09\/venezuela-coup-regime-change\/\">during the first Trump presidency<\/a>, on federal charges of narco-terrorism and conspiracy to import cocaine. Last month, the U.S. doubled its reward for information leading to Maduro\u2019s arrest to $50 million.<\/p>\n<p>Speaking on Fox News, Hegseth did not rule out regime change by the U.S. in Venezuela. \u201cThat\u2019s a presidential-level decision and we\u2019re prepared with every asset that the American military has,\u201d he said.<\/p>\n<p>Two armed Venezuelan F-16 fighter jets flew over the U.S. Navy guided-missile destroyer Jason Dunham in the southern Caribbean Sea in a show of force on Thursday.\u00a0 The Pentagon called it a \u201chighly provocative move\u201d that was \u201cdesigned to interfere with our counter-narco-terror operations\u201d and issued a threat. <\/p>\n<p>\u201cThe cartel running Venezuela is strongly advised not to pursue any further effort to obstruct, deter or interfere with counternarcotics and counterterrorism operations carried out by the U.S. military,\u201d read the <a href=\"https:\/\/x.com\/DeptofDefense\/status\/1963775938233299235\">statement<\/a> released on X Thursday night.<\/p>\n<p>Hegseth declined to say what type of weapons were used in the Tuesday strike but referenced \u201cassets that we have in the region\u201d include a \u201cMEU\u201d or Marine Expeditionary Unit \u201cwhich holds 2,200 combat infantry Marines and has plenty of its own organic assets.\u201d He added: \u201cSo we\u2019ve got assets in the air, assets in the water, assets on ships, because this is a deadly serious mission for us.\u201d<\/p>\n<p>The Intercept <a href=\"https:\/\/theintercept.com\/2025\/09\/02\/trump-military-venezuela-drug-boat\/?utm_medium=email&amp;utm_source=The%20Intercept%20Newsletter\">previously reported<\/a> that U.S. Marines and sailors from the <a href=\"https:\/\/theintercept.com\/2025\/09\/02\/trump-military-venezuela-drug-boat\/?utm_medium=email&amp;utm_source=The%20Intercept%20Newsletter\">22nd Marine Expeditionary Unit<\/a> recently deployed to southern Puerto Rico.\u00a0The 22nd MEU did not reply to repeated requests for comment about whether they were involved in the Tuesday attack.<\/p>\n<p>All told,\u00a0around 4,500 U.S. personnel, <a href=\"https:\/\/www.reuters.com\/world\/us\/us-builds-up-forces-caribbean-officials-experts-ask-why-2025-08-29\/\" target=\"_blank\" rel=\"noreferrer noopener\">seven U.S. warships<\/a>\u00a0and one nuclear-powered attack submarine are either in the Caribbean or are expected to arrive there soon.\u00a0<\/p>\n<p><span class=\"has-underline\">Several government officials<\/span> suggested to The Intercept that Rear Adm. Milton \u201cJamie\u201d Sands III, head of Naval Special Warfare Command, was <a href=\"https:\/\/news.usni.org\/2025\/08\/22\/navy-reserve-naval-special-warfare-leaders-removed-from-command\">fired<\/a> by Defense Secretary Pete Hegseth late last month due to the admiral\u2019s concerns about impending attacks on civilian vessels in international waters.<\/p>\n<p>Pentagon Press Secretary Kingsley Wilson pushed back on the officials\u2019 claims. \u201cNo, that\u2019s not accurate,\u201d she replied by email. Sands did not respond to requests by The Intercept for an interview prior to publication.<\/p>\n<p>Tuesday\u2019s strike, as carried out, fell under the authority of U.S. Southern Command. Sands oversaw the Navy\u2019s SEAL teams, so would not have been in the operational chain of command for the Tuesday strike, and would not have had authority to approve or reject the planned operation.<\/p>\n<p>Last month, more than 30\u00a0humanitarian, public interest, immigrant rights, faith-based, veterans\u2019 advocacy, and drug policy reform groups <a href=\"https:\/\/theintercept.com\/2025\/08\/15\/trump-mexico-war-cartels\/\">called on\u00a0Congress<\/a> to oppose the use of military force against drug cartels in Latin America by the Trump administration.<\/p>\n<p>Melding two failed American wars \u2014 the war on drugs and the war on terror \u2014 would \u201cput people at risk of violence and destabilize hemispheric relations while hindering, not helping, efforts to protect communities from drug trafficking and other crime,\u201d <a href=\"https:\/\/winwithoutwar.org\/37-groups-to-congress-reject-trumps-dangerous-push-for-war-in-latin-america\/\">according<\/a> to the organizations, which include Alianza Americas, Center for Civilians in Conflict, Drug Policy Alliance, Public Citizen, and Win Without War.<\/p>\n<p>\u201cThe U.S. posture towards the eradication of drugs has caused immeasurable damage across our hemisphere. It has led to massive forced displacement, environmental devastation, violence, and human rights violations. What it has not done is any damage whatsoever to narcotrafficking or to the cartels. It has been a dramatic, profound failure at every level,\u201d said Omar. \u201cTrump and Rubio\u2019s apparent solution, to make it even more militarized, is doomed to fail.
