{"id":3610,"date":"2025-06-11T01:33:04","date_gmt":"2025-06-11T01:33:04","guid":{"rendered":"https:\/\/gunowner-news.com\/?p=3610"},"modified":"2025-06-11T01:33:04","modified_gmt":"2025-06-11T01:33:04","slug":"feds-seek-unprecedented-sentence-boost-for-cia-leaker-asif-rahman","status":"publish","type":"post","link":"https:\/\/gunowner-news.com\/?p=3610","title":{"rendered":"Feds Seek \u201cUnprecedented\u201d Sentence Boost for CIA Leaker Asif Rahman"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p><span class=\"has-underline\">Top U.S. Justice Department<\/span> officials are worried that Asif William Rahman, a former CIA analyst who leaked reports about Israel\u2019s plans for a strike on Iran, isn\u2019t going to get a harsh enough sentence.<\/p>\n<p>That\u2019s why, his defense lawyers said, the government is making an \u201cunprecedented\u201d request for Rahman to get a sentence 50 percent longer than the high end of what guidelines recommend \u2014 despite his cooperation with prosecutors.<\/p>\n<p>Prosecutors asked that Rahman get three years more than the five to six-year guideline because his leaks \u201ccould have\u201d harmed national security. In doing so, they claimed in court that he used technical wizardry to cover his tracks, but a review by The Intercept suggests that he employed typical hobbyist apps.<\/p>\n<p>Rahman\u2019s lawyers, meanwhile, asked for the judge to reject the government\u2019s request. They say Rahman was acting under the stress of a traumatic tour of duty in Iraq, personal tragedy, and a desire to advance peace in the Middle East. They say classified documents filed under seal provide no evidence that his leaks hurt U.S. interests.<\/p>\n<p>\u201cThe government\u2019s request for an upward variance in this case is unprecedented and contrary to the parties\u2019 understanding of how both the government and Mr. Rahman would benefit from an early plea with full cooperation,\u201d they said. \u201cIt is also a violation of the law, as it relies substantially on information that Mr. Rahman provided in the course of his cooperation. For these reasons, and to uphold the rule of law, the Court should disregard this belated, unlawful, and unjust recommendation.\u201d<\/p>\n<p>The dueling briefs filed in federal court over the past month offer deeper insight into the motivations of Rahman, whose leaks may have<a href=\"https:\/\/theintercept.com\/2024\/12\/06\/cia-leak-asif-rahman-israel-iran\/\"> briefly delayed Israel\u2019s strike on Iran<\/a>, while highlighting high-level interest in the case from Donald Trump\u2019s administration.<\/p>\n<p>Rahman\u2019s leaks briefly drew global attention last year during<a href=\"https:\/\/theintercept.com\/2024\/04\/14\/israel-iran-drag-us-war-netanyahu-biden\/\"> escalating attacks <\/a>between Israel and Iran tied to the Gaza war.<\/p>\n<p>The leaks of analyses of satellite photos of Israel\u2019s preparations for a strike on Iran surfaced on social media in October. Prosecutors would later claim that they delayed Israel\u2019s \u201ckinetic action\u201d against its rival in the Middle East.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-high-level-pressure-on-sentence\">High-Level Pressure on Sentence<\/h2>\n<p>Rahman began cooperating with prosecutors after his November arrest while stationed at the U.S. Embassy in Cambodia.<\/p>\n<p>His lawyers said he submitted to three daylong debriefings intended to help the government avoid future \u201cinsider threats.\u201d He has also forked over the passwords for his encrypted devices.<\/p>\n<p>Rahman<a href=\"https:\/\/theintercept.com\/2025\/01\/17\/cia-leaker-plea-asif-rahman\/\"> pleaded guilty<\/a> on January 17, with an understanding from federal prosecutors in the U.S Attorney\u2019s Office for the Eastern District of Virginia that both sides would agree that federal sentencing guidelines recommend a term of roughly five to six years.<\/p>\n<p>Then Trump came into office \u2014 and the understanding between the government and defense began to collapse. CIA Deputy Director Michael Ellis, a Trump appointee known for his loyalty to the president, wrote a letter to the court dated May 1 making serious allegations about fallout from the leaks.<\/p>\n<p>\u201cAt an unclassified level, I can confirm that Mr. Rahman\u2019s unauthorized disclosures have caused serious, and in some instance exceptionally grave, damage to U.S. national security and the CIA,\u201d he wrote. More information was included in a classified appendix, he said.<\/p>\n<p>Prosecutors followed that letter up with a brief where they asked U.S. District Judge Patricia Tolliver Giles to go well above the guideline\u2019s upper range of 6.5 years.<\/p>\n<p>The prosecutors on the case, however, stopped short of echoing the farfetched claims of harm from Ellis. Instead, they said that sealed filings in the case \u201cdetail the catastrophic harms that could have occurred because of the defendant\u2019s actions.\u201d<\/p>\n<p>Defense lawyers soon cried foul. They said it was \u201cunprecedented\u201d for prosecutors to seek such a sharp upward variance on a sentence after agreeing to what would be the guideline range under federal law. In violation of the plea agreement, the government\u2019s request relied on information that Rahman himself had offered to investigators, they added.<\/p>\n<p>The request was not prompted by local prosecutors, they claimed. Instead, defense lawyers blamed \u201cMain Justice\u201d \u2014 referring to the Justice Department\u2019s headquarters \u2014 for directing local lawyers to take the hard-nosed position. They also said there was nothing in the classified documents backing up Ellis\u2019s claim of actual harm.<\/p>\n<figure class=\"wp-block-ft-photo is-style-default\">\n    <figcaption class=\"photo__figcaption\">\n              <span class=\"photo__caption\">List of applications found at CIA leaker Asif William Rahman\u2019s desk.<\/span><br \/>\n                    <span class=\"photo__credit\">Source: U.S. Sentencing Memorandum<\/span><br \/>\n          <\/figcaption><\/figure>\n<h2 class=\"wp-block-heading\" id=\"h-fortified\">Fortified?<\/h2>\n<p>Prosecutors have separately played up Rahman\u2019s supposed technical sophistication, pointing to a handwritten list of apps they found at his residence in Cambodia. Those apps, the government says, were \u201call intended to fortify Android electronic devices against interception and discovery.\u201d<\/p>\n<p>Yet at a minimum, the government\u2019s claims appear to be significantly overstated, according to an Intercept analysis. The apps Rahman listed were the type that might appeal to anyone with an interest in playing around with the inner workings of their phone settings, as opposed to someone hellbent on fortifying their device.<\/p>\n<p>The list of 12 apps include an <a href=\"https:\/\/adaway.org\/\">ad blocker<\/a>, a <a href=\"https:\/\/www.keepassdx.com\/\">password manager,<\/a> a <a href=\"https:\/\/nordvpn.com\/\">VPN<\/a>, a <a href=\"https:\/\/signal.org\/\">secure messaging app<\/a>, a <a href=\"https:\/\/llamalab.com\/automate\/\">task automation app<\/a>, and a firewall \u2014 in other words, basic consumer apps which people who want a way to manage their passwords, or who don\u2019t want to see ads, routinely have on their phones.<\/p>\n<p>The remainder of the itemized apps include an alternate Android operating system, <a href=\"https:\/\/lineageos.org\/\">LineageOS<\/a>, which facilitates device customization, and various other tweaking apps popular in hobbyist circles of people that modify Android phones.<\/p>\n<p>None of the listed apps appear to be explicitly intended to \u201cfortify Android electronic devices against interception and discovery.\u201d<\/p>\n<p>The government also noted that the listed apps, which include the encrypted messaging service Signal, were \u201coutside of any government-suggested platforms.\u201d<\/p>\n<p>As the<a href=\"https:\/\/theintercept.com\/2025\/03\/26\/signal-chat-yemen-strike\/\"> Yemen strike messaging scandal<\/a> revealed, the Signal app is routinely used by government agencies, <a href=\"https:\/\/theintercept.com\/2025\/03\/25\/signal-chat-encryption-hegseth-cia\/\">including the CIA.<\/a><\/p>\n<h2 class=\"wp-block-heading\" id=\"h-genuine-remorse\">\u201cGenuine Remorse\u201d<\/h2>\n<p>Since his arrest, Rahman has taken a penitent stance, expressing what his lawyers call \u201cgenuine remorse\u201d while cooperating with government investigators.<\/p>\n<p>The defense has requested a sentence of 13 months, which, with time already served, would mean that Rahman spends about half a year more behind bars.<\/p>\n<p>Rahman\u2019s defense attorneys say the Yale University graduate\u2019s record at the CIA was spotless.
