It\u2019s a rare and aggressive step to involve active-duty troops in civilian law enforcement activities.<\/p>\n<p>A defense official, speaking on the condition of anonymity for fear of retribution, called the activation of the Marines a \u201cprovocation\u201d designed to foster to a \u201cmanufactured crisis.\u201d<\/p>\n<p>Experts question the legality of the mobilization of the Marines.<\/p>\n<p>On Saturday, President Donald Trump took the already extraordinary action of calling up more than 2,000 National Guard troops to tamp down demonstrations in California. In doing so, he <a href=\"https:\/\/theintercept.com\/2025\/06\/08\/trump-national-guard-ice-immigration-protests-los-angeles\/\">exercised rarely used federal powers<\/a> that bypassed Gov. Gavin Newsom\u2019s authority.\u00a0<\/p>\n<p>He followed it up two days later with an even more extreme move. While it is unclear under what authority Trump and the Defense Department\u00a0did so, U.S. Northern Command activated 700 Marines from the 2nd Battalion, 7th Marines, 1st Marine Division, assigned to Twentynine Palms, California. They are being shipped out to support Task Force 51 \u2014 a deployable <a href=\"https:\/\/www.arnorth.army.mil\/Media\/News\/Article\/2642644\/task-force-51-ensures-readiness-for-hurricane-responses\/\">command post\u00a0<\/a>used in crisis response \u2014 \u201cwho are protecting federal personnel and federal property in the greater Los Angeles area,\u201d according to a statement issued by NORTHCOM. \u00a0<\/p>\n<p>\u201cThe level of escalation is completely unwarranted, uncalled for, and unprecedented \u2014 mobilizing the best in class branch of the U.S. military against its own citizens,\u201d Newsom\u2019s office said in a statement.<\/p>\n<p>\u201cMilitary presence is not needed. The state is already working with local partners <a href=\"https:\/\/www.gov.ca.gov\/2025\/06\/09\/100885\/\">to surge 800+ additional state and local law enforcement officers into Los Angeles<\/a> to clean up President Trump\u2019s mess,\u201d Tara Gallegos, a spokesperson for Newsom, told The Intercept by email.<\/p>\n<p><!-- BLOCK(cta)[0](%7B%22componentName%22%3A%22CTA%22%2C%22entityType%22%3A%22SHORTCODE%22%2C%22optional%22%3Atrue%7D)(%7B%7D) --><\/p>\n<p><!-- END-BLOCK(cta)[0] --><\/p>\n<p>Experts say that the introduction of the Marines further strains civil-military relations and risks violation of the Posse Comitatus Act: a bedrock 19th-century law seen as fundamental to the democratic tradition in America. The Posse Comitatus Act bars federal troops from participating in civilian law enforcement.<\/p>\n<figure class=\"wp-block-pullquote has-text-align-right\">\n<blockquote>\n<p>\u201cThis is obviously an extreme escalation that is going to pour gasoline on an already combustible situation.\u201d<\/p>\n<\/blockquote>\n<\/figure>\n<p>\u201cThis is obviously an extreme escalation that is going to pour gasoline on an already combustible situation,\u201d said Elizabeth Goitein, senior director of the Brennan Center\u2019s liberty and national security program. \u201cIt\u2019s almost inevitable that the Marines are going to be laying hands on civilians and exercising the kinds of coercive powers that would normally be illegal under the Posse Comitatus Act.\u201d<\/p>\n<p>The Trump administration is attempting to justify its escalatory tactics by claiming people <a href=\"https:\/\/theintercept.com\/collections\/chilling-dissent\/\">protesting<\/a> his <a href=\"https:\/\/theintercept.com\/collections\/the-war-on-immigrants\/\">anti-immigration agenda<\/a> constitute a rebellion or threaten to become one.<\/p>\n<p>The directive signed by Trump, calling up the Guard, cites \u201c<a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/USCODE-2011-title10\/html\/USCODE-2011-title10-subtitleE-partII-chap1211-sec12406.htm\" target=\"_blank\" rel=\"noreferrer noopener\">10 U.S.C. 12406<\/a>,\u201d\u00a0a provision within Title 10 of the U.S. Code on Armed Services that allows the federal deployment of National Guard forces if \u201cthere is a rebellion or danger of a rebellion against the authority of the Government of the United States.\u201d<\/p>\n<p>\u201cTask Force 51 is now comprised of approximately 2,100 National Guard soldiers in a Title 10 status and 700 active-duty Marines,\u201d according to NORTHCOM and have \u201cbeen trained in de-escalation, crowd control, and standing rules for the use of force.\u201d<\/p>\n<p>The Marines \u201chave the same task and purpose as the National Guard,\u201d said another defense official who spoke with The Intercept on the condition of anonymity in order to speak freely. \u201cYou can think of them as an additional force to do the same thing. They just happen to be active-duty Marines. But all of the troops in total who are doing this are all activated under Title 10.\u201d<\/p>\n<p>Goitein disputes that Marines can be employed under the same authority as the National Guard.<\/p>\n<p>\u201cLegally, they can\u2019t rely on the same authority. They\u2019re not in the same position legally,\u201d she said. Title \u201c10 U.S.C. 12406 applies to the National Guard. It doesn\u2019t apply to the active-duty armed forces.\u201d<\/p>\n<p>Goitein also pointed to the cultural difference and the public perceptions that separate National Guard troops from the active-duty armed forces.<\/p>\n<p>\u201cActive-duty troops, like these Marines, are full-time professional soldiers. Protests, as of the afternoon, were largely orderly and peaceful.<\/p>\n<p>\u201cMobilizing Marines against their neighbors is a profoundly dangerous escalation. This deployment is plainly illegal, and it points to the reason why we have laws against these deployments in the first place,\u201d Sara Haghdoosti, the executive director of Win Without War, told The Intercept. \u201cNot only is it an authoritarian power grab, it also threatens the physical health of people exercising their constitutional rights to protest and to the moral health of Marines now ordered to suppress those rights.\u201d<\/p>\n<p>On the streets of Los Angeles on Monday afternoon, Steve Hill, a protester who said he is a Marine Corps veteran, said service members should know better.<\/p>\n<p>\u201cWhoever the commanding officer is should know that we don\u2019t follow orders that are unlawful.
