Trump Is Telling Them to Run Wild."},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<figure class=\"wp-block-ft-photo is-style-default\">\n    <figcaption class=\"photo__figcaption\">\n              <span class=\"photo__caption\">Donald Trump holds an executive order on policing at the White House in Washington on June 16, 2020.<\/span><br \/>\n                    <span class=\"photo__credit\">Photo: Stefani Reynolds\/CNP\/Bloomberg via Getty Images<\/span><br \/>\n          <\/figcaption><\/figure>\n<p><span class=\"has-underline\">Donald Trump says<\/span> he wants to \u201cunleash\u201d the police.<\/p>\n<p>This week, Trump <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/04\/strengthening-and-unleashing-americas-law-enforcement-to-pursue-criminals-and-protect-innocent-citizens\/\">signed<\/a> an executive order \u201cSTRENGTHENING AND UNLEASHING AMERICA\u2019S LAW ENFORCEMENT TO PURSUE CRIMINALS AND PROTECT INNOCENT CITIZENS\u201d (all caps in the original), laying down a host of authoritarian diktats intended to make police officers more brutal, more loyal to him, and less accountable to anyone other than him.<\/p>\n<p>The proclamation is more virtue signaling than policy \u2014 more an expression of Trump\u2019s mood than a serious proposal. And, when it comes to conventional crime, Trump\u2019s mood is right <a href=\"https:\/\/www.washingtonpost.com\/news\/the-watch\/wp\/2017\/08\/01\/trump-policing-and-the-teenage-brain\/\">where it\u2019s always been<\/a>: fearful, demagogic, and perpetually stuck in 1988.<\/p>\n<figure class=\"wp-block-pullquote has-text-align-right\">\n<blockquote>\n<p>The proclamation is more an expression of Trump\u2019s mood than a serious proposal.<\/p>\n<\/blockquote>\n<\/figure>\n<p>The thing that ties it all together is a word Trump uses often \u2014 \u201cunleash\u201d \u2014 and it\u2019s worth delving into. The literal definition is to remove from a restraint. In the context of law enforcement, it conjures images of cops siccing police dogs on suspects or protesters. Metaphorically, we tend to associate the word with starker imagery. We <em>unleash<\/em> fury, wrath, and retribution. Trump wants to project both.<\/p>\n<p>As for the executive order itself, it is heavy on bluster and short on details, like most of Trump\u2019s orders.<\/p>\n<p>Some of the measures are nonsensical, like \u201cindemnifying\u201d police from damages. (They\u2019re already indemnified by taxpayers in <a href=\"https:\/\/nyulawreview.org\/issues\/volume-89-number-3\/police-indemnification\/#:~:text=My%20study%20reveals%20that%20police,rights%20violations%20by%20law%20enforcement.\">more than 99.9 percent<\/a> of such cases.) For others, it isn\u2019t clear if he\u2019s referring to federal or state and local police. Trump provides no funding for his demands.<\/p>\n<p>Some would violate the law, such as charging progressive prosecutors for failing to prosecute some crimes to Trump\u2019s satisfaction. Others, like directing law firms to do pro bono work defending cops accused of wrongdoing, are unconstitutional on their own \u2014 not to mention that they build on other directives from Trump that courts are also likely to find unconstitutional. Still others would require approval from Congress.<\/p>\n<p>How much of this agenda is actually feasible depends on whether Trump is willing to push through these barriers, and whether the federal <a href=\"https:\/\/theintercept.com\/2025\/04\/08\/trump-big-law-firms-paul-weiss-courts\/\">courts<\/a> <a href=\"https:\/\/theintercept.com\/2025\/04\/08\/trump-big-law-firms-paul-weiss-courts\/\">are willing to stop him<\/a>. That, however, is true with or without an executive order.<\/p>\n<p><!-- BLOCK(cta)[0](%7B%22componentName%22%3A%22CTA%22%2C%22entityType%22%3A%22SHORTCODE%22%2C%22optional%22%3Atrue%7D)(%7B%7D) --><\/p>\n<p><!-- END-BLOCK(cta)[0] --><\/p>\n<h2 class=\"wp-block-heading\" id=\"h-what-leash\">What Leash?<\/h2>\n<p>During his run in presidential politics, Trump has <a href=\"https:\/\/www.pbs.org\/newshour\/show\/trump-under-fire-again-for-comments-on-police-violence-and-harris-mental-competence\">praised<\/a> and<a href=\"https:\/\/www.politico.com\/news\/2024\/09\/29\/trump-violent-day-policing-crime-00181619\"> encouraged<\/a> police brutality. He has <a href=\"https:\/\/www.businessinsider.com\/trump-congratulates-china-communist-anniversary-amid-brutal-hong-kong-crackdown-2019-10\">applauded<\/a> violent crackdowns on protests, especially by <a href=\"https:\/\/www.independent.co.uk\/news\/world\/americas\/tiananmen-square-video-1990-interview-china-massacre-protests-demonstrations-a9545591.html\">authoritarian regimes<\/a>.<\/p>\n<p>He believes in projecting strength, and believes strong leaders demonstrate strength with violence. This is why he has often suggested that police officers <a href=\"https:\/\/www.thedailybeast.com\/trump-warns-it-would-be-very-bad-if-my-police-biker-gang-fans-decided-to-get-tough-on-my-opponents\/\">will attack his enemies<\/a> if called upon, and why the Capitol Police who defended Congress from his supporters received so much of his wrath.<\/p>\n<p>Yet you can\u2019t unleash something that has never been restrained in the first place. And in the U.S., the police have never been restrained.<\/p>\n<p>Last month, an <a href=\"https:\/\/kfor.com\/news\/local\/were-citizens-oklahoma-city-family-traumatized-after-ice-raids-home-but-they-werent-suspects\/\">Oklahoma City news station<\/a> reported that a federal team of law enforcement officers had battered down the door of a Latino woman and her three daughters. The family was subjected to a terrifying raid, in which agents held them at gunpoint, forced them to stand in the rain, then rifled through their home.<\/p>\n<p>The agents were looking for undocumented immigrants. Everyone in the home was a U.S. citizen. The man they were looking for had moved out months earlier.<\/p>\n<p>If it had all stopped there, that would have been bad enough. This was a violent, volatile raid over an alleged immigration violation \u2014 an extraordinarily disproportionate use of force. After learning of their mistake, however, the agents weren\u2019t apologetic or contrite. Instead, they confiscated the family\u2019s computers, cellphones, and an undisclosed amount of cash.<\/p>\n<p>The agents didn\u2019t identify themselves or which agency they were with, and they left no contact information so the women could file a complaint or, at the very least, retrieve their property. <\/p>\n<p>According to the victim, one officer told her as they left, \u201cI know it was a little rough this morning.\u201d After several days, the Department of Homeland Security finally acknowledged a mistake.<\/p>\n<p>This raid followed Trump\u2019s executive order, but it\u2019s part of a much longer pattern of hyper-aggressive law enforcement. These certainly weren\u2019t the actions of law officers who felt restrained. <\/p>\n<p>And why would they? Trump and his subordinates have made clear that one clear objective of his <a href=\"https:\/\/theintercept.com\/collections\/the-war-on-immigrants\/\">immigration policy<\/a> is to<a href=\"https:\/\/www.texastribune.org\/2019\/12\/16\/trump-administration-knew-family-separations-harm-migrant-children\/\"> inflict pain<\/a>. According to Guti\u00e9rrez\u2019s cousin, one agent said, \u201cNo, he\u2019s not the one.\u201d Another replied, \u201cTake him anyway.\u201d<\/p>\n<p>Guti\u00e9rrez has no criminal record. He was in the country legally. He doesn\u2019t even have tattoos. Yet before his family could act, he had been sent to a facility in Texas. He was then among the first batch of people sent to El Salvador\u2019s Terrorism Confinement Center, or CECOT, prison, a slave labor detention facility. The ICE agents who arrested him haven\u2019t even been identified, much less disciplined. Immigration \u201cczar\u201d Tom Homan later referred to such wrongful arrests of legal residents <a href=\"https:\/\/abc7ny.com\/post\/father-fighting-get-son-returned-cecot-prison-immigration-raid-deportation\/16276963\/\">as <\/a>\u201c<a href=\"https:\/\/abc7ny.com\/post\/father-fighting-get-son-returned-cecot-prison-immigration-raid-deportation\/16276963\/\">collateral<\/a>.\u201d<\/p>\n<p>These are just two of a<a href=\"https:\/\/abcnews.go.com\/US\/noncitizens-deported-alien-enemies-act-criminal-records-ice\/story?id=119912375\"> growing number<\/a> of horrifying incidents in which federal agents, often concealing their identities with masks, have<a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/federal-immigration-authorities-detain-international-tufts-graduate-st-rcna198158\"> snatched<\/a> innocent people from the streets, then whisked them off to to detention centers hundreds of miles away or, worse yet, all the way to CECOT. None of this suggests police officers feel all that restrained.<\/p>\n<p>The courts haven\u2019t restrained them either. In the 2022 case <a href=\"https:\/\/www.oyez.org\/cases\/2021\/21-147\">Egbert v. Boulet<\/a>, the Supreme Court all but barred anyone from suing federal law enforcement officers for violating constitutional rights. In so doing, the court overturned a 50-year-old precedent, arguing that the old ruling created a cause of action that had never been approved by Congress.<\/p>\n<p>The court, however, has also been chipping away at Congress\u2019s attempts to hold bad cops accountable. Incredibly, constitutional lawyer Patrick Jaicomo <a href=\"https:\/\/kfor.com\/news\/local\/homeland-security-admits-oklahoma-raid-targeted-wrong-people\/\">first learned about<\/a> the raid in Oklahoma City this week as he was leaving the Supreme Court. Jaicomo, who works for the libertarian nonprofit Institute for Justice, had just given oral arguments for a case in which federal law enforcement officers had waged a violent drug raid on the wrong home, holding an innocent family and 10-year-old child at gunpoint.<\/p>\n<p>Because the court has already prevented victims like Jaicomo\u2019s clients from suing under the Constitution, <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24-362\/351456\/20250307121332188_Martin%20v.%20United%20States%20Petitioners%20Merits%20Brief.pdf\">he was left to argue<\/a> that they should be able to sue under the Federal Tort Claims Act, the one<a href=\"https:\/\/www.washingtonpost.com\/opinions\/2020\/02\/14\/state-federal-task-forces-are-out-control\/\"> less-than-ideal<\/a> remedy still available to hold abusive federal cops accountable. And in fact, after a series of botched drugs raids on innocent people in the 1970s, Congress created an addition to that law specifically allowing for lawsuits in cases of botched raids. Yet the lower courts have refused to allow the lawsuit to go forward, and <a href=\"https:\/\/www.supremecourt.gov\/oral_arguments\/argument_transcripts\/2024\/24-362_8njq.pdf\">judging from oral arguments<\/a>, the Supreme Court doesn\u2019t seem eager to allow it either.<\/p>\n<p>Congress also passed a law to give people a way to sue when state and local police violate their rights: the KKK Act, passed during Reconstruction. The Supreme Court has been whittling that away too, through the<a href=\"https:\/\/www.washingtonpost.com\/opinions\/2021\/10\/26\/ugly-origins-qualified-immunity\/\"> doctrine of qualified immunity<\/a>, a legal fiction the court invented from whole cloth.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-immune-from-most-lawsuits\">Immune (From Most Lawsuits)<\/h2>\n<p>The world in which police officers are hamstrung by overly restrictive rules and woke prosecutors exists only in the minds of Donald Trump and his followers. <\/p>\n<p>In truth, state and local police are protected by qualified immunity and in the tiny percentage of cases in which victims can actually get in front of a jury, then convince that jury to convict and award damages, the police are further shielded by indemnification. Federal police \u2014 and any state and local police who serve on federal drug, gang, or immigration task forces \u2014 are all but immune from lawsuits.<\/p>\n<p>Well, from most lawsuits. There is at least one federal lawsuit that has a decent shot at a substantial settlement. <\/p>\n<p>Last year Trump himself <a href=\"https:\/\/www.cnn.com\/2024\/08\/12\/politics\/trump-mar-a-lago-search-claim\/index.html\">sued the FBI for $100 million<\/a> over the search of his Mar-a-Lago home. Unlike the raids in Oklahoma City or Atlanta, the FBI agents intentionally conducted the search of Trump\u2019s Florida estate while he was out of town to avoid embarrassing him. Among the abuses Trump claims to have suffered: FBI agents <a href=\"https:\/\/www.rollingstone.com\/politics\/politics-news\/trump-rages-fbi-shoes-bedroom-mar-a-lago-raid-1234595546\/\">didn\u2019t remove their shoes<\/a> before entering his bedroom.<\/p>\n<p>The difference now is that Trump controls the Justice Department, and the Supreme Court has given him the green light to exploit the department\u2019s power and resources in whatever corrupt manner he pleases. <\/p>\n<p>It wouldn\u2019t be at all surprising if Trump ordered the department to settle with him for $100 million for the indignity of shoed FBI feet traipsing through his bedroom, while simultaneously directing federal police to <a href=\"https:\/\/reason.com\/2025\/04\/25\/justice-department-memo-claims-alien-enemies-act-allows-warrantless-home-searches-and-no-judicial-review\/\">continue with warrantless raids<\/a> on anyone who speaks with an accent.<\/p>\n<p>In the end, Trump doesn\u2019t really need to unleash the police.
