{"id":3449,"date":"2025-05-02T07:57:54","date_gmt":"2025-05-02T07:57:54","guid":{"rendered":"https:\/\/gunowner-news.com\/?p=3449"},"modified":"2025-05-02T07:57:54","modified_gmt":"2025-05-02T07:57:54","slug":"trumps-pick-for-a-top-army-job-works-at-a-weapons-company-and-wont-give-up-his-stock","status":"publish","type":"post","link":"https:\/\/gunowner-news.com\/?p=3449","title":{"rendered":"Trump&#8217;s Pick for a Top Army Job Works at a Weapons Company \u2014 And Won&#8217;t Give Up His Stock"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p><span class=\"has-underline\">Trump\u2019s nominee for<\/span> under secretary of the Army, Michael Obadal, retired from a career in the Army in 2023, then spent the past two years working for Anduril, the ascendant arms maker with billions of dollars in Army contracts.<\/p>\n<p>If confirmed to the Pentagon post \u2014 often described as the \u201cchief operating officer\u201d position at the largest branch of the U.S. military \u2014 Obadal plans to keep his stock in Anduril, according to an<a href=\"https:\/\/extapps2.oge.gov\/201\/Presiden.nsf\/PAS+Index\/22D2862F18C6328885258C6F002C8B8D\/$FILE\/Obadal%2C%20Michael%20%20finalEA.pdf\"> ethics disclosure<\/a> reviewed by The Intercept.<\/p>\n<p>\u201cThis is unheard of for a presidential\u00a0appointee in the Defense Department to retain a financial interest in a defense contractor,\u201d said Richard Painter, the top White House ethics lawyer during the George W. Bush administration. Painter said that while the arrangement may not be illegal, it certainly creates the appearance of a conflict of interest. Under the norms of prior administrations, Painter said, \u201cnobody at upper echelons of the Pentagon would be getting anywhere near contracts if he\u2019s sitting on a pile of defense contractor stock.\u201d<\/p>\n<p>Obadal has been a senior director at Anduril since 2023, according to his LinkedIn profile, following a nearly 30-year career in the U.S. Army. While the <a href=\"https:\/\/theintercept.com\/2021\/08\/19\/afghanistan-taliban-defense-industry-media\/\">revolving door<\/a> between <a href=\"https:\/\/theintercept.com\/2020\/12\/08\/biden-defense-secretary-lloyd-austin-raytheon\/\">the Pentagon and defense industry<\/a> is as<a href=\"https:\/\/theintercept.com\/2017\/03\/21\/revolving-door-military\/\"> old <\/a>as both of those institutions, federal law and ethical norms require employees of the executive branch to unload financial interests and relationships that might create a conflict of interest in the course of their duties.<\/p>\n<p>Obadal\u2019s April 11 financial disclosure letter, filed with the Office of Government Ethics, states \u201cUpon confirmation, I will resign from my position as Senior Director at Anduril Industries\u201d and forfeit his right to unvested stock options. But crucially, Obadal says he will retain his restricted stock units that have already vested \u2014 i.e., Anduril stock he already owns. That means he will continue to own a piece of the company, whose valuation has <a href=\"https:\/\/www.reuters.com\/business\/aerospace-defense\/anduril-talks-new-funding-round-with-possible-28-billion-valuation-sources-say-2025-02-07\/\">reportedly<\/a> increased from $8.5 billion when Obadal joined to $28 billion today on the strength of its military contracts, and stands to materially benefit from anything that helps Anduril.<\/p>\n<p>In his ethics letter, Obadal says he \u201cwill not participate personally and substantially in any particular matter that to my knowledge has a direct and predictable effect on the financial interests of Anduril Industries\u201d \u2014 unless he\u2019s given permission by his boss, the secretary of the Army.<\/p>\n<p>Don Fox, former acting director of the Office of Government Ethics, told The Intercept Obadal\u2019s Anduril shares could pose a clear conflict of interest if he is confirmed. \u201cThe general reason an appointee would be allowed to maintain a potentially conflicting interest is because divestiture is either not possible or highly impractical.\u201d Anduril is privately held, meaning shares in the company can\u2019t be quickly disposed of on the stock market.<\/p>\n<p>But Painter, the Bush-era ethics lawyer, suggests that Obadal could liquidate his stake in Anduril through the <a href=\"https:\/\/www.businessinsider.com\/investors-secondary-shares-in-anduril-2025-3\">lively secondary market<\/a> in its shares. \u201cIn the Bush years, we\u2019d just say \u2018You\u2019re not going to the Pentagon,\u201d said Painter. \u00a0<\/p>\n<p><!-- BLOCK(cta)[0](%7B%22componentName%22%3A%22CTA%22%2C%22entityType%22%3A%22SHORTCODE%22%2C%22optional%22%3Atrue%7D)(%7B%7D) --><\/p>\n<p><!-- END-BLOCK(cta)[0] --><\/p>\n<p>Fox said that if Obadal adheres to what\u2019s in his ethics agreement and recuses himself from anything that touches Anduril, he will stay in compliance with federal law. \u201cThat\u2019s going to be a pretty broad recusal,\u201d added Painter, who speculated, \u201cHe\u2019s going to have to recuse from any weapons systems that might use [Anduril] equipment, anything having to do with contracts, even competitor companies.\u201d<\/p>\n<p>Fox, who spent decades as a lawyer at the Air Force and Navy, speculated that a vast recusal from budgetary matters \u201cis feasible, but he\u2019s going to have to be really scrupulous about it,\u201d to the point of literally leaving the room whenever Anduril, its capabilities, or those of its competitors are discussed. \u201cOnce we get into areas that involve hardware and software, I\u2019d say don\u2019t even be in the room,\u201d he said. \u201cAt a really senior level, people are not only looking for what you say but what you don\u2019t say,\u201d Fox added. \u201cIt poses a significant risk to him personally of crossing that line, no matter how scrupulous he may be.\u201d<\/p>\n<p>William Hartung, a senior research fellow at the Quincy Institute for Responsible Statecraft who\u00a0focuses on the U.S. arms industry, describes the situation as \u201cthe very\u00a0definition of a conflict of interest\u201d given the vast business interests between Obadal\u2019s current and new employer. \u201cThe fact that the administration and the Congress have accepted this arrangement is a commentary on the sad state of ethics in Washington \u2014 an indication\u00a0that too many of our elected officials won\u2019t even\u00a0<em>try<\/em>\u00a0to take steps to make it harder to engage in corrupt practices,\u201d Hartung added.<\/p>\n<p><!-- BLOCK(newsletter)[1](%7B%22componentName%22%3A%22NEWSLETTER%22%2C%22entityType%22%3A%22SHORTCODE%22%2C%22optional%22%3Atrue%7D)(%7B%7D) --><\/p>\n<div class=\"newsletter-embed flex-col items-center print:hidden\" id=\"third-party--article-mid\" data-module=\"InlineNewsletter\" data-module-source=\"web_intercept_20241230_Inline_Signup_Replacement\">\n<div class=\"-mx-5 sm:-mx-10 p-5 sm:px-10 xl:-ml-5 lg:mr-0 xl:px-5 bg-accentLight hidden\" data-name=\"subscribed\">\n<h2 class=\"font-sans font-light uppercase text-[30px] leading-8 text-white tracking-[0.01em] mb-0\">\n      We\u2019re independent of corporate interests \u2014 and powered by members. Having a former employee and current shareholder in that position may prove lucrative for Anduril as the company seeks to add to its billions of dollars of federal contracts.<\/p>\n<p>In the past year alone, during Obadal\u2019s time at the company, Anduril <a href=\"https:\/\/www.anduril.com\/article\/anduril-and-microsoft-partner-to-advance-integrated-visual-augmentation-system-ivas-program-for\/\">announced<\/a> it was taking over the Army\u2019s Integrated Visual Augmentation System, a troubled $22 billion program intended to provide soldiers with augmented reality goggles and <a href=\"https:\/\/www.anduril.com\/article\/developing-the-future-of-precision-fires-and-affordable-mass-anduril-s-new-rocket-motor-for-the\/\">selling<\/a> the Army components for its rocket artillery systems and a fleet of <a href=\"https:\/\/www.anduril.com\/article\/ghost-x-selected-for-u-s-army-s-company-level-suas-directed-requirement\/\">miniature<\/a> \u201cGhost-X\u201d helicopter drones. Anduril is also working on the Army\u2019s TITAN system, a truck-mounted sensor suite, and an experimental U.S. Army\u2019s Robotic Combat Vehicle program.<\/p>\n<p>Last year, DefenseOne reported that the Army\u2019s \u201cunfunded priorities\u201d tech wishlist included \u201c$4.5 million in research and development for Anduril\u2019s Roadrunner-M drone interceptor.\u201d Obadal described that jet-powered bomb drone in a LinkedIn <a href=\"https:\/\/www.linkedin.com\/feed\/update\/urn:li:ugcPost:7136218490738286592?commentUrn=urn%3Ali%3Acomment%3A%28ugcPost%3A7136218490738286592%2C7136319352131223552%29&amp;dashCommentUrn=urn%3Ali%3Afsd_comment%3A%287136319352131223552%2Curn%3Ali%3AugcPost%3A7136218490738286592%29\">post<\/a> as \u201crevolutionary.\u201d<\/p>\n<p>The White House declined to comment on the ethics agreement and referred The Intercept to the Office of the Secretary of Defense, which also declined to comment and referred The Intercept to the Army, which referred The Intercept back to the White House. Neither Anduril nor Obadal responded to a request for comment.<\/p>\n<p>Even amid a rightward turn for the tech industry, Anduril <a href=\"https:\/\/theintercept.com\/2024\/11\/17\/tech-industry-trump-military-contracts\/\">stands out<\/a> for its <a href=\"https:\/\/www.wired.com\/story\/big-interview-trae-stephens-has-built-ai-weapons-and-worked-for-donald-trump-as-he-sees-it-jesus-would-approve\/\">MAGA-alignment<\/a> and closeness to the Trump administration of its <a href=\"https:\/\/x.com\/teddyschleifer\/status\/1799577806856196458\">top executives<\/a> and investors.<\/p>\n<p>In December, the New York Times <a href=\"https:\/\/www.nytimes.com\/2024\/12\/06\/us\/politics\/trump-elon-musk-silicon-valley.html\">reported<\/a> Trump\u2019s transition team offices were \u201ccrawling with executives from defense tech firms with close ties to Mr. Trump\u2019s orbit,\u201d including Anduril.
