They Blew It."},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p><span class=\"has-underline\">Attorney General Pam<\/span> Bondi distributed plans inside the Justice Department last week to scrap rules protecting journalists and their sources from surveillance and subpoenas over unflattering coverage and leaks. Bondi\u2019s memo leaked to the press <a href=\"https:\/\/bsky.app\/profile\/eoinhiggins.bsky.social\/post\/3lno3bzwhn22f\">immediately<\/a>.<\/p>\n<p>\u201cThis Justice Department will not tolerate unauthorized disclosures that undermine President Trump\u2019s policies, victimize government agencies, and cause harm to the American people,\u201d reads the<a href=\"https:\/\/www.documentcloud.org\/documents\/25919721-attorney-general-bondi-memorandum-updated-policy-regarding-obtaining-information-from-or-records-of-members-of-the-news-media\/\"> memo<\/a>, citing recent leaks to the New York Times, Washington Post, and Reuters as examples of the kind of reporting that would no longer be tolerated. \u201cI have concluded that it is necessary to rescind [former attorney general] Merrick Garland\u2019s policies precluding the Department of Justice from seeking records and compelling testimony from members of the news media in order to identify and punish the source of improper leaks.\u201d<\/p>\n<p>Eliminating these rules is the latest signal of a looming threat to reporters, who could face subpoenas and search warrants for daring to publish information that President Donald Trump would prefer kept secret. Journalists who resist legal demands to disclose their sources could face fines or even jail time.<\/p>\n<p>But it didn\u2019t have to be this way.<\/p>\n<p>Long before Trump was reelected on promises to punish disfavored reporters and outlets, free press advocates <a href=\"https:\/\/chicago.suntimes.com\/2022\/12\/3\/23490469\/first-amendment-press-freedom-reporter-shield-law-dick-durbin-seth-stern-op-ed\">warned<\/a> that the rescinded Justice Department rules were an inadequate shield. The Biden DOJ last <a href=\"https:\/\/theintercept.com\/2022\/11\/05\/justice-department-reporters-classified\/\">revised the rules<\/a> in 2022 in light of revelations about the first Trump administration\u2019s spying on journalists to smoke out leakers. Along the way, even as it offered <a href=\"https:\/\/theintercept.com\/2025\/01\/12\/trump-justice-department-new-york-post-wsj-leak\/\">its own leaks<\/a> to friendly outlets, the first Trump DOJ <a href=\"https:\/\/theintercept.com\/2024\/12\/11\/trump-justice-department-spied-journalists-congress\/\">routinely ignored<\/a> prior versions of the rules, which are not enforceable in court.\u00a0<\/p>\n<p>Last year, Senate Democrats had a clear opportunity to make basic protections for journalists a matter of binding federal law, rather than mere policy that could be undone with a vendetta-laced memo. Following years of debate over the proper scope of a federal shield law for reporters, the <a href=\"https:\/\/www.congress.gov\/bill\/118th-congress\/senate-bill\/2074\">PRESS Act<\/a> unanimously passed the House of Representatives and had a bipartisan roster of Senate sponsors, including Republican Lindsay Graham of South Carolina.<\/p>\n<p>Then Democratic leaders blew it.<\/p>\n<p><!-- BLOCK(cta)[0](%7B%22componentName%22%3A%22CTA%22%2C%22entityType%22%3A%22SHORTCODE%22%2C%22optional%22%3Atrue%7D)(%7B%7D) --><\/p>\n<p><!-- END-BLOCK(cta)[0] --><\/p>\n<p>For months, they let the PRESS Act sit in the Senate Judiciary committee without a hearing, even though that committee\u2019s chair, Dick Durbin, D-Ill., was the bill\u2019s co-sponsor.<\/p>\n<p>After the election, Trump demanded that Republicans <a href=\"https:\/\/theintercept.com\/2024\/11\/21\/press-act-trump-press-freedom\/\">kill the bill<\/a>. Chuck Schumer, D-N.Y., swore the PRESS Act was a top priority for his last weeks as Senate majority leader. But neither he nor Durbin put any apparent effort into moving the bill forward, either on its own or as part of must-pass legislation like the defense budget. They offered statements of reassurance and support for the press, but no action.<\/p>\n<p>In mid-December, with time running out, Sen. Ron Wyden, D-Ore., the PRESS Act\u2019s lead sponsor, <a href=\"https:\/\/www.wyden.senate.gov\/news\/press-releases\/wyden-calls-for-passage-of-press-act?ref=thedissenter.org\">tried to advance<\/a> it himself, bringing the bill to the Senate floor on a motion to enact it by unanimous consent. A single Republican, Sen. Tom Cotton of Arkansas, blocked it with <a href=\"https:\/\/www.cotton.senate.gov\/news\/speeches\/cotton-speaks-against-the-press-act\">a grandstanding speech<\/a> about the evils of leaks and \u201cAmerica-hating and fame-hungry journalists,\u201d as he\u2019d<a href=\"https:\/\/www.cotton.senate.gov\/news\/speeches\/cotton-speaks-against-the-press-act\"> done<\/a> with prior versions of the PRESS Act.<\/p>\n<figure class=\"wp-block-pullquote\">\n<blockquote>\n<p>\u201cEveryone predicted this would happen in a second Trump administration, yet politicians in a position to prevent it prioritized empty rhetoric over putting up a meaningful fight.\u201d<\/p>\n<\/blockquote>\n<\/figure>\n<p>Despite the predictable opposition, Senate Democrats had no strategic plan to counter it \u2014 other than a <a href=\"https:\/\/freedom.press\/issues\/speeches-arent-enough-pass-the-press-act\/\">speech by Schumer<\/a> \u2014 and the PRESS Act died at the end of the session. Durbin\u2019s office blamed the PRESS Act\u2019s failure on Cotton\u2019s obstruction but did not answer why Durbin allowed the bill to stall in his committee. Durbin recently<a href=\"https:\/\/www.politico.com\/news\/2025\/04\/23\/dick-durbin-retirement-age-generational-change-00306671\"> announced<\/a> that he is retiring after more than four decades in Congress. Hegseth, who is <a href=\"https:\/\/theintercept.com\/2025\/04\/25\/pentagon-defense-secretary-pete-hegseth-leaks-signal\/\">obsessed with finding out<\/a> who\u2019s leaking details of his own terrible security practices, has also threatened to use lie detectors.<\/p>\n<p>What procedural protections will remain for journalists as Bondi and her deputies prosecute these investigations is still unknown. Her memo was clear that the Biden-era rules were rescinded but light on details as to what might take their place. The memo referred to recent updates in the <a href=\"https:\/\/www.justice.gov\/jm\/jm-9-13000-obtaining-evidence#9-13.400\">DOJ\u2019s manual<\/a> and <a href=\"https:\/\/www.ecfr.gov\/current\/title-28\/chapter-I\/part-50\/section-50.10\">federal regulations<\/a>, but updated language has not yet been published and the DOJ did not respond to The Intercept\u2019s request for copies.<\/p>\n<p>Where the prior rules barred subpoenas against reporters except under narrow circumstances, Bondi\u2019s memo emphasized the lack of clear legal protection for journalists against such subpoenas under Supreme Court precedent.<\/p>\n<p>Trump \u201ccan and almost certainly will abuse the legal system to investigate and prosecute his critics and the journalists they talk to,\u201d Stern said in his statement.<\/p>\n<p>Such abuses can take many forms, including using subpoenas to obtain a reporter\u2019s <a href=\"https:\/\/theintercept.com\/2021\/06\/08\/cellphone-records-government-journalists\/\">phone <\/a>and email records, which the first Trump DOJ did for at least eight reporters at three national outlets: the Washington Post, CNN, and the New York Times. The Obama administration <a href=\"https:\/\/theintercept.com\/2018\/01\/03\/my-life-as-a-new-york-times-reporter-in-the-shadow-of-the-war-on-terror\/\">tried to force<\/a> former New York Times reporter James Risen, who later joined The Intercept, to testify about his sources, but eventually dropped the effort.<\/p>\n<p>According to Bondi\u2019s memo, a subpoena for a reporter\u2019s testimony, notes, or correspondence should be \u201can extraordinary measure to be deployed as a last resort,\u201d narrowly drawn, and subject to \u201cenhanced approval and advance-notice procedures,\u201d which Bondi did not spell out. Any arrests of reporters would be subject to her personal go-ahead, as would requests to interrogate journalists.<\/p>\n<p>\u201cTrump is laying the groundwork to lock up reporters who don\u2019t rat out their sources who expose crimes by his administration,\u201d Wyden, the PRESS Act\u2019s lead Senate sponsor, <a href=\"https:\/\/bsky.app\/profile\/wyden.senate.gov\/post\/3lnobpnqtuk2h\">wrote<\/a> on Bluesky after the Bondi memo came out. \u201cI have a bipartisan bill that would make these protections ironclad.
