{"id":3258,"date":"2025-04-03T11:54:59","date_gmt":"2025-04-03T11:54:59","guid":{"rendered":"https:\/\/gunowner-news.com\/?p=3258"},"modified":"2025-04-03T11:54:59","modified_gmt":"2025-04-03T11:54:59","slug":"insulin-test-used-to-convict-lucy-letby-of-murder-was-unreliable-experts-say","status":"publish","type":"post","link":"https:\/\/gunowner-news.com\/?p=3258","title":{"rendered":"Insulin Test Used to Convict Lucy Letby of Murder Was Unreliable, Experts Say"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div data-testid=\"companionColumn-0\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">A half-dozen pediatric doctors and toxicology experts said on Thursday that jurors were misled by prosecutors who cited unreliable insulin tests during the trial of Lucy Letby, a nurse <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2024\/10\/24\/world\/europe\/lucy-letby-nurse-appeal-murder.html\" title=\"\">convicted of murdering seven babies at a British hospital<\/a>.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The doctors made their assertions in a new report that Ms. Letby\u2019s lawyer submitted to Britain\u2019s Criminal Cases Review Commission, which is responsible for investigating possible miscarriages of justice, in the hopes of being allowed to pursue a full appeal of her 15 life sentences.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Ms. Letby, who worked as a nurse in a neonatal unit at a hospital in northern England, was found guilty in 2023 of deliberately harming \u2014 and in seven cases, murdering \u2014 babies by injecting them with air, overfeeding them with milk, infusing air into their gastrointestinal tracts or poisoning them with insulin.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In the new report, the six experts, who include a forensic toxicologist, a professor of forensic science and an endocrinologist who has written multiple peer-reviewed <a class=\"css-yywogo\" href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/28765408\/\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">papers on medical test errors,<\/a> attacked the validity of the evidence of insulin poisoning used by the prosecution at trial.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-1\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">\u201cOur inescapable conclusion is that this evidence significantly undermines the validity of the assertions made about the insulin and C-peptide testing presented in Court,\u201d they wrote in a summary of the report provided to reporters by her legal team.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Ms. Letby has always maintained her innocence. Since her two trials, <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/21\/world\/europe\/lucy-letby-nurse-murder.html\" title=\"\">serious questions<\/a> <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/02\/04\/world\/europe\/lucy-letby-nurse-uk-appeal-evidence.html\" title=\"\">have been raised<\/a> about her guilt, including in a <a class=\"css-yywogo\" href=\"https:\/\/www.newyorker.com\/magazine\/2024\/05\/20\/lucy-letby-was-found-guilty-of-killing-seven-babies-did-she-do-it\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">13,000-word New Yorker article<\/a> last May. But efforts by her lawyers to reopen the case with a full appeal have been repeatedly denied.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-2\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The new report focuses on two babies \u2014 known as babies F and L \u2014 whose blood sugar levels dropped to low levels, but who later recovered. Ms. Letby was convicted of trying to murder the two babies by adding insulin to their food, causing a condition called hypoglycemia.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Tests suggested that the babies had high levels of insulin but only a negligible amount of C-peptide, a substance detected when insulin is produced by the body. The prosecution argued the insulin must therefore have been administered externally.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-3\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">In the new report, the experts present what they describe as \u201cconvincing new evidence from multiple sources\u201d showing serious problems with the test results used to demonstrate that Ms. Letby poisoned two of the babies with insulin.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">They said the test, called \u201cthe Roche immunoassay,\u201d was known to result in \u201cfalsely high insulin results.\u201d They also argued that there were other ways for infants to receive insulin, including through the placenta while they are in their mother\u2019s womb.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The experts said that when evidence was presented to jurors about the levels of insulin found in the small infants, the prosecution referred to the wrong data.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cStudies in adults and older children were quoted which are not relevant, and the limited appropriate information was not referred to,\u201d they wrote.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">They said the testing \u201cdid not meet acceptable forensic standards\u201d and that the results of the Roche test, in particular, should not have been relied on without being confirmed by more precise laboratory tests.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-4\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">The Royal Liverpool Hospital laboratory where the tests were conducted explicitly warns in its online guidance that they are <a class=\"css-yywogo\" href=\"https:\/\/pathlabs.rlbuht.nhs.uk\/insulin.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">\u201cnot suitable\u201d<\/a> for investigating low blood sugar created by an insulin injection. \u201cIf exogenous insulin administration is suspected as the cause of hypoglycemia, please inform the laboratory so that the sample can be referred externally for analysis,\u201d it says. But both babies recovered, so their samples were never referred anywhere else.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">The experts said that prosecutors and the police had not considered other ways that the babies became hypoglycemic besides foul play.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThere are alternative medical explanations which explain the hypoglycemia in both babies, such as line failure, sepsis and perinatal stress-induced hyperinsulinism,\u201d they wrote. \u201cThese alternative possibilities were not considered.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Questions about the accusations of insulin poisoning have been raised publicly by doctors in the months since the trial. Thursday\u2019s 86-page report is an effort by Mark McDonald, Ms. Letby\u2019s lawyer, to present those questions to the commission in a formal way.<\/p>\n<p class=\"css-at9mc1 evys1bk0\">\u201cThe conclusions of the report on Babies F and L clearly demonstrate that the case must go back to the Court of Appeal as a matter of urgency,\u201d Mr. McDonald said in a statement.<\/p>\n<\/div>\n<aside class=\"css-ew4tgv\" aria-label=\"companion column\"\/><\/div>\n<div data-testid=\"companionColumn-5\">\n<div class=\"css-53u6y8\">\n<p class=\"css-at9mc1 evys1bk0\">He added: \u201cLucy Letby is currently serving 15 whole life terms in prison, when overwhelming independent expert evidence indicates that no babies were murdered.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">In a <a class=\"css-yywogo\" href=\"https:\/\/thirlwall.public-inquiry.uk\/wp-content\/uploads\/2025\/03\/Written-Closing-Submission-of-Family-Group-2-and-3-7-March-2025.pdf\" title=\"\" rel=\"noopener noreferrer\" target=\"_blank\">statement to a public inquiry<\/a> last month, lawyers representing some of the families of babies who died or were harmed at the Countess of Chester Hospital said: \u201cThe families have no doubts about Letby\u2019s guilt.\u201d<\/p>\n<p class=\"css-at9mc1 evys1bk0\">Mr. McDonald also submitted to the Criminal Cases Review Commission a full 698-page examination of Ms. Letby\u2019s case by a separate panel of experts, led by the renowned Canadian neonatologist <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/03\/21\/world\/europe\/lucy-letby-nurse-murder.html\" title=\"\">Dr. Shoo Lee<\/a>, who previewed <a class=\"css-yywogo\" href=\"https:\/\/www.nytimes.com\/2025\/02\/04\/world\/europe\/lucy-letby-nurse-uk-appeal-evidence.html\" title=\"\">their findings in February<\/a>.
